DGMB Casino, LLC, and each of our affiliates, casinos and resorts (collectively, “Resorts”) have an unwavering commitment to providing outstanding products and services to our customers. This Privacy Policy applies to the information Resorts collects online through websites controlled and maintained by Resorts (the “Site” or “Sites”) and information it collects through other methods, including but not limited to through its application(s), reservation procedures, loyalty program, surveys, guest comments, market research, and other means by which we interact with you (collectively with the Sites, our “Services”).

II. YOUR CONSENT TO THIS POLICY

You should read this Policy carefully so that you understand our privacy practices.  By accessing, browsing, downloading, or otherwise using the Services, you confirm that you have read, understood, and agreed with this Statement.  If you do not agree to this Statement, you may not use the Services. You hereby acknowledge that this Privacy Policy is incorporated in the Terms and Conditions of Use that control your use and access of the Sites.

This Statement applies regardless of how the Services are accessed and will cover any technologies or devices by which we make the Services available to you. We may provide you with additional privacy notices where we believe it is appropriate to do so, such as when you submit an application for a line of credit. We collect information you voluntarily provide to us directly, information collected automatically when you interact with our Site and Services, and information we receive from third parties, such as our service providers and affiliates.  The categories of personal information that we collect and the purposes for which we collect that information are described below.

a. The Categories of Information We Collect and Why We Collect Them

The following list describes the categories of personal information we collect.

  • Account Information includes name, email address, username and password, government issued identification such as Driver’s License, preferences, and statistics. It also includes certain information about your interactions with us, such as your reservations and account balances. We collect this information when you provide it directly to us and through your interactions with our Services. We collect this information for the purposes of account creation and management, compliance with legal obligations, advertising and marketing, analytics and research, customer service, fraud prevention, and website security and maintenance.
  • Analytics Information. We collect certain analytics information automatically as you navigate our Site and Services. This includes cookies, tracking pixels, tags or similar tools, which may collect information about your browser, device, geolocation, and interactions with the Services, Site, or emails. We collect this information for the purposes of account creation and management, advertising and marketing, analytics and research, customer service, fraud prevention, and website security and maintenance.
  • Contact Information includes name, email address, physical address, and phone number. We collect this information when you provide it directly to us such as by registering for our Services, signing up for offers or newsletters, requesting information about Resorts’ products, creating an account, or filling out a form. We may also receive this information from our affiliates and service providers, such as when you book a stay with us through a third party website. We collect this information for the purposes of account creation and management, advertising and marketing, analytics and research, customer service, fraud prevention, and website security and maintenance.
  • Commercial History includes information regarding your interactions with us, such as the purchases or reservations you have make and the details of these purchases. It also includes your subscription and purchase preferences, goods or services you have viewed or considered, payment information, and how the products and services you interact with on our Sites. We may collect this information directly from you or through our partners and affiliates through whom you place orders. We collect this information for the purposes of account creation and management, advertising and marketing, analytics and research, customer service, improving our Services, and security and fraud prevention. Please note that any information you provide through a third party website may be processed in accordance with the terms set forth on that website. This Policy applies only to Resorts’ information management practices, not those of third parties.
  • Communications Information includes information that you submit to us when you contact us for customer service or other purposes, such as information collected through our call center. This information includes your Contact Information and the contents of any communications you send to us. We collect this information for the purposes of providing our Services, customer service, and internal analytics and research.
  • Gaming Activity includes information regarding your interactions with our table games and slot machines. We collect this information for the purposes of account management, improving our Services, marketing and advertising, analytics and research, and security and fraud prevention.
  • Loyalty Rewards Information includes Account Information, Commercial History, Gaming Activity, and any other information you provide to us regarding your preferences. We collect this information when you sign up for our Rewards Program and when you use your Resorts Star Card. We process this information to provide our Loyalty Rewards program, improve our Services, for marketing and advertising, and security and fraud prevention.   • Payment Information includes the information you provide when making a purchase, such as your credit or debit card information, copies of checks, or bank account information. We collect this information for the purpose of processing your transactions with us.
  • Responses to Surveys and Questionnaires includes any information you provide to us when you voluntary complete market research surveys or respond to in-person questionnaires, such as email address and information regarding your interests. We collect this information for the purposes of advertising and marketing, analytics and research, customer service, and improving our Services.
  • Social Media Information includes information that you tag us in, post by sharing on a blog or another social media platform, or information regarding our content that you share online. We collect this information when you post it publicly, share it through links in our Services, or provide it directly to us. Please note that your comments will be visible to the public, so you should never share personal information that you would like to keep private. We collect this information for the purposes of advertising and marketing, analytics and research, customer service, and website security and maintenance. We reserve the right to delete disparaging or inappropriate comments.

The following chart identifies the purposes for which we process your personal information, the relevant categories of information we may process for each purpose, and the manner in which we may disclose your personal information.  Please note that we may not collect each category of information about each user of our Services and may not disclose information about each user depending on the nature of your relationship with us.

We also reserve the right to share your personal information to establish, exercise, or defend our legal and property rights, including providing information to others for the purposes of fraud prevention. We do not use analytical tools in a manner that discloses to third parties that a specific person viewed specific video materials.

 

c.      How Long Do Cookies Stay on My Device?

Some cookies operate from the time you visit the Services until the end of that particular browsing session.  These cookies, which are called “session cookies,” expire and are automatically deleted when you close your Internet browser. Some cookies will stay on your device between browsing sessions and will not expire or automatically delete when you close your Internet browser.  These cookies are called “persistent cookies” and the length of time they will remain on your device will vary from cookie to cookie.  Persistent cookies are used for a number of purposes, such as storing your preferences so that they are available for your next visit and to keep a more accurate account of how often you visit the Services, how your use of the Services may change over time, and the effectiveness of advertising efforts.

e.      Does the Site Respond to “Do Not Track” Signals?

There is currently no industry agreed-upon response to a Do Not Track signal.  At this time, our Site does not respond differently based on a user’s Do Not Track signal. However, we take reasonable efforts to ensure that our Site complies with the opt-out requirements set forth under applicable law.

 

V.  THIRD PARTY ADVERTISING

We may use third-party advertising companies to serve advertisements that may be of interest to you based on your interactions with our Site or Services. These third parties, such as Google or Meta, may use unique Cookies to collect or receive information from our Site and elsewhere on the Internet to target advertisements and measure the effectiveness of our ads. We may also target advertisements to you on third party platforms, such as Facebook, based on your activities on our Site and interactions with our Services. The information collected by these third parties may be processed by these third parties pursuant to the terms of their individual privacy policies.

 

VI. STATE DATA PRIVACY RIGHTS

Users may be entitled to certain rights with respect to their personal data pursuant to applicable state data protection laws. For example, residents of Delaware and New Jersey are entitled to exercise certain rights pursuant to the Delaware Personal Data Privacy Act and the New Jersey Data Protection Act respectively. Please note that each of these rights is subject to restrictions and limitations and Resorts may be required to verify your identity prior to fulfilling rights requests.

b.  Sensitive Information

Sensitive Data as defined under Delaware and New Jersey law includes precise geolocation information.  For the purposes of serving you relevant advertisements based on your location, we collect geolocation information to perform geofencing.  We will not collect precise geolocation information from Delaware and New Jersey residents without first obtaining consent.

If necessary, we may request additional information reasonably necessary to authenticate your identity and your request.

In certain circumstances, you may make a request on behalf of another such as if you are an authorized agent.  We request that you provide all information necessary for us to verify the relationship between an authorized agent and the principal and reserve the right to request any additional information necessary to authenticate the relationship.

We will respond to these consumer requests, if applicable, within 45 days of receipt of the request and without undue delay.  If we need to extend this period, we will notify you of the delay and explain the reasonably necessary justifications for our delay.

We will provide responses to your requests free of charge unless certain exclusions apply, depending on the state in which you reside.  We may charge a fee if you make more than one request in a twelve-month period or if your request is manifestly unfounded, excessive, or repetitive in nature.

d.     Appealing a Rights Request Decision

Residents of Delaware and New Jersey may appeal any decisions we make regarding their requests. You may only submit an appeal once an initial decision has been made. To submit an appeal, please email us at [email protected]. In the email appeal, please specify the right(s) you requested to exercise and the date you made such a request.

We will inform you in writing within 45 days of any action taken or not taken in response to the appeal.  We will also provide a written explanation of the reasons for our decisions regarding your request(s).

VII. ADVERTISING AND MARKETING CHOICE

We respect your rights in how your personal information is used and shared. If at any time you would like to unsubscribe from receiving future emails, you may visit https://resortsac.com/email-opt-out/ or follow the instructions at the bottom of each email, and we will promptly remove you from marketing correspondence. You may also request to be removed from our mailing lists in person at our promotional booths and kiosks at any time. Please note, however, that we may still need to contact you regarding other non-marketing related matters.

VIII. DATA PROCESSING IN THE UNITED STATES

Resorts is based in the United States and does not intentionally target its Services to individuals outside of United States. Therefore, we process personal information on our servers in the United States and reserve the right to store or processing information in other countries where permitted by applicable law.  If you use our Services or otherwise provide us with information from outside of the United States, you expressly consent to the transfer of your data to the United States and the processing of your data in accordance with the terms of this Policy.

IX. OUR COMMITMENT TO DATA SECURITY

The security of your personal information is important to us.  We take various reasonable organizational, administrative, and technical measures to protect your personal information from unauthorized access, disclosure, alteration, or destruction.  If required by law to do so, we will notify you and/or the relevant supervisory authority in the event of a data breach. However, we cannot and do not guarantee complete security, as it does not exist on the Internet.

X. RETENTION OF PERSONAL INFORMATION

We will retain your personal information until the personal information is no longer necessary to accomplish the purpose for which it was collected.  We may retain your personal information for longer periods for specific purposes to the extent that we are obligated to do so in accordance with applicable laws and regulations; to protect you, other people, and us from fraud, abuse, and unauthorized access; as necessary to protect our legal rights; or for certain reasonable business requirements.

XI. THIRD PARTY LINKS AND EMBEDDED CONTENT

Our Site and Services may contain links to third-party websites.  When we provide links, we do so only as a convenience and we are not responsible for any content of any third party website or any links contained within.  Additionally, we may provide embedded content, such as videos, on our websites.  Although these videos are available through our website, they are actually hosted and provided by third parties.  Such third parties may place cookies or related tracking devices on your systems when you view such embedded content.

This Statement only applies to Resorts’ Services.  We are not responsible and assume no responsibility for any personal information collected, stored, or used by any third party as a result of you visiting third-party websites or viewing embedded content.  We advise that you carefully read the privacy notice of any third-party websites you choose to visit.

XII.  CHILDREN’S PRIVACY

Protecting the privacy of the very young is especially important.  Our Services are not intended for children or individuals under 21 years of age, and we do not knowingly collect personal information from such individuals.  In the event that we learn that we have collected personal information from a child or individual under the age of 21, we will immediately delete that information.  If you believe that we might have any information from or about a child or individual under 21, please contact us using the information provided in the “Contact Us” section below.

This Policy may change from time to time.  Any changes to this Policy will be posted to this webpage and effective as of the day of publication.  Where reasonably necessary or required by law, we will notify you of any changes directly.
